Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Rentnear platform, including our website, mobile applications, customer support channels, and all services provided by Rentnear Technologies Private Limited ("Rentnear", "we", "our", or "us"). These Terms should be read together with our Privacy Policy, Shipping Policy, Damage & Loss Policy, Refund & Cancellation Policy, Lender Policy, Borrower Policy, and any other policies published on the Rentnear Platform, all of which form an integral part of this Agreement.

For the purposes of these Terms, the words "User," "You," or "Your" refer to any individual, business entity, partnership, proprietorship, company, organisation, or other legal person who accesses or uses the Rentnear Platform. By accessing, registering, listing products, renting products, or using any service provided through Rentnear, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms and all related policies.

Only persons who are legally competent to enter into a binding contract under the Indian Contract Act, 1872, are permitted to use the Rentnear Platform. Individuals who are below the age of 18 years, persons of unsound mind, undischarged insolvents, or any person otherwise disqualified under applicable law are not eligible to create an account, enter into rental transactions, or use Rentnear services independently.

Although products rented through Rentnear may ultimately be used by individuals below the age of 18 years, the rental agreement, payment obligations, security deposits, and all legal responsibilities must be undertaken solely by a parent, legal guardian, or any person who is legally competent to contract under Indian law. Rentnear reserves the absolute right to suspend, restrict, or permanently terminate any account if it is discovered that the account has been created or operated in violation of these eligibility requirements.

Where a person accesses or uses Rentnear on behalf of a company, partnership, organisation, educational institution, or any other legal entity, such person represents and warrants that they possess the necessary authority to bind that entity to these Terms. In such cases, all obligations, liabilities, and responsibilities under these Terms shall apply equally to both the authorised representative and the entity they represent.

Unlike a traditional rental company, Rentnear operates as a technology-enabled rental marketplace. Product owners ("Lenders") list their products on the platform, while customers ("Renters") book those products through Rentnear. Rentnear facilitates identity verification, secure payments, booking management, customer support, logistics coordination (where applicable), and dispute resolution. Unless expressly stated otherwise, ownership of every listed product always remains with the respective Lender, and Rentnear does not acquire ownership rights over products listed by users.

By confirming a rental booking on Rentnear, both the Lender and the Renter enter into a legally binding rental agreement governed by these Terms, together with all applicable Rentnear policies. Every user agrees to fulfil their respective obligations throughout the rental period and to cooperate with Rentnear in resolving any disputes arising from a transaction.

Rentnear provides a platform that enables temporary access to products through rentals. By completing a booking, the Renter receives a limited, non-exclusive, and non-transferable right to use the rented product solely for the approved rental period. This right is granted only upon successful payment of all applicable rental charges, security deposits (if applicable), verification requirements, and confirmation of the booking.

The rental transaction does not transfer ownership of the product to the Renter under any circumstances. Legal ownership of the product shall remain with the respective Lender at all times unless ownership is transferred through a separate written agreement outside the scope of the Rentnear Platform.

The Renter agrees to use the product responsibly, only for its intended purpose, and in accordance with the manufacturer's operating instructions and all applicable laws. The Renter shall take reasonable care of the product throughout the rental period and shall return it in substantially the same condition in which it was received, subject only to reasonable wear and tear arising from normal and proper use.

The Renter shall not sell, pledge, mortgage, lease, sub-rent, modify, dismantle, tamper with, or transfer possession of the rented product to any third party without the prior written consent of the Lender and Rentnear. Any unauthorised transfer, misuse, or illegal use of the rented product shall constitute a material breach of these Terms and may result in financial liability, suspension of the user's account, or legal proceedings.

Rentnear reserves the right to suspend or cancel any rental transaction where fraud, misrepresentation, misuse, illegal activity, or any violation of these Terms is suspected.

The rental period shall commence on the booking start date and continue until the scheduled return date selected by the Renter during the booking process and confirmed by Rentnear. The applicable rental duration, rental charges, security deposit (if applicable), delivery schedule, pickup schedule, and return date shall be displayed during checkout and confirmed in the booking confirmation issued to both parties.

The Renter agrees to return the rented product, along with all accessories, manuals, packaging, and complimentary items supplied with the product, on or before the agreed return date. The product must be returned in substantially the same condition in which it was delivered, allowing only for reasonable wear and tear resulting from proper use.

If the Renter wishes to return the product before the expiry of the agreed rental period, such early return shall not automatically entitle the Renter to any refund or reduction of the rental charges already paid, unless expressly permitted under Rentnear's Refund and Cancellation Policy.

If the Renter wishes to extend the rental duration, an extension request must be submitted through the Rentnear Platform before the scheduled return date. Extension requests are subject to product availability, approval by the Lender, operational feasibility, and any additional rental charges. Rentnear does not guarantee that an extension request will be approved.

Failure to return the product by the agreed return date without an approved extension may result in additional rental charges, late return fees, suspension of the user's account, recovery proceedings, or any other action deemed necessary by Rentnear to protect the interests of the Lender and the Platform.

In exceptional circumstances, including maintenance requirements, product recalls, legal restrictions, force majeure events, or safety concerns, Rentnear reserves the right to modify, postpone, or terminate a rental booking after notifying the affected users and providing an appropriate resolution in accordance with applicable policies.

Access to the publicly available portions of the Rentnear Platform does not require registration. However, users must create a valid Rentnear Account to access core services offered through the Platform, including but not limited to listing products for rent, booking rental products, making or receiving payments, managing bookings, communicating with other users through authorised channels, tracking transactions, submitting support requests, and accessing other features made available by Rentnear from time to time.

To create a Rentnear Account, the user shall provide complete, accurate, and up-to-date information as requested during the registration process. Such information may include, but is not limited to, the user's full name, mobile number, email address, residential address, date of birth, identity verification documents, payment details, and any additional information required by Rentnear for compliance, fraud prevention, or operational purposes. By registering an account, the user represents and warrants that all information provided is true, accurate, current, and complete, and agrees to promptly update such information whenever any changes occur.

The user shall be solely responsible for maintaining the confidentiality and security of their account credentials, including their username, password, one-time passwords (OTPs), authentication codes, and any other security information associated with the Rentnear Account. The user shall not share, transfer, sell, or permit any other person to access or operate their account. Any activity carried out using the user's account shall be deemed to have been performed by the registered account holder, who shall remain fully responsible for all transactions, communications, obligations, and liabilities arising from such use, whether authorised or unauthorised, unless otherwise determined by applicable law.

Rentnear may offer users the option to register or log in using supported third-party authentication services, including but not limited to Google, Apple, Facebook, or other identity providers that may be introduced from time to time. Where a user chooses to register through a third-party service, the user authorises Rentnear to receive and use certain account information made available by that service, subject to the user's privacy settings and the terms and conditions governing the third-party provider. The user's relationship with any third-party authentication provider shall remain solely between the user and such provider, and Rentnear shall not be responsible for the availability, security, functionality, or policies of any third-party authentication service.

By connecting a third-party account, the user confirms that they have the legal authority to grant Rentnear access to the information shared through such account and that doing so does not violate any agreement between the user and the third-party service provider. Rentnear shall access, store, and process only such information as is necessary to facilitate authentication, account creation, and the services requested by the user, in accordance with the Rentnear Privacy Policy.

To maintain the integrity and security of the marketplace, Rentnear may require users to complete identity verification at any stage of account registration or during continued use of the Platform. Verification may include mobile number verification, email verification, government-issued identity documents, PAN verification, selfie verification, bank account verification, business registration documents, proof of address, or any other documentation that Rentnear reasonably considers necessary. Rentnear reserves the right to approve, reject, suspend, or request additional information before completing the verification process.

The user agrees that Rentnear may conduct reasonable verification checks, including fraud prevention screening, risk assessments, duplicate account detection, sanction screening, or other compliance procedures, either directly or through authorised third-party verification partners. Failure to successfully complete any required verification process may result in limitations on the user's ability to access certain services or complete transactions on the Platform.

The user further agrees that if any information provided during registration or thereafter is found to be false, inaccurate, incomplete, misleading, outdated, fraudulent, or inconsistent with these Terms of Use, or if Rentnear reasonably suspects that such information is unreliable or has been provided for unlawful purposes, Rentnear shall have the absolute right, without prior notice, to suspend, restrict, temporarily disable, permanently terminate, or refuse access to the user's account and any associated services. Rentnear may also cancel pending bookings, withhold payouts where legally permissible, and report suspected fraudulent activities to the appropriate authorities where required under applicable law.

Users are prohibited from creating multiple accounts for fraudulent purposes, impersonating another individual or organisation, using another person's identity, creating accounts using temporary or disposable contact information, or attempting to circumvent account restrictions imposed by Rentnear. Any such activity shall constitute a material breach of these Terms and may result in permanent suspension of all associated accounts, cancellation of transactions, forfeiture of applicable platform privileges, and legal action where appropriate.

Rentnear reserves the right to modify the account registration process, introduce additional verification requirements, implement enhanced security measures, or update eligibility criteria at any time in order to improve platform security, comply with applicable laws, prevent fraud, and ensure a safe and trustworthy rental marketplace for all users. Continued use of the Platform following such updates shall constitute acceptance of the revised registration requirements and associated policies.

By accessing or using the Rentnear website, mobile application, or any of our services, you agree to use the platform responsibly, lawfully, and in accordance with these Terms of Use. Rentnear is committed to creating a safe, secure, and trustworthy rental marketplace for everyone. Every user is expected to respect the rights of other users, comply with applicable laws, and maintain honest and professional conduct while using the platform.

Users must not upload, post, publish, transmit, or share any content that is false, misleading, fraudulent, defamatory, abusive, threatening, harassing, obscene, pornographic, hateful, discriminatory, violent, or otherwise unlawful. Content that promotes terrorism, illegal activities, money laundering, gambling, hate speech, child exploitation, or violates public morality or the laws of India is strictly prohibited. Rentnear reserves the absolute right to remove such content immediately and permanently suspend or terminate the associated account without prior notice.

Users shall not upload or list counterfeit products, stolen goods, prohibited items, restricted products, hazardous materials, illegal substances, weapons prohibited by law, pirated software, copyrighted material without authorization, or any product that infringes upon the intellectual property rights of another person or entity. Every user is solely responsible for ensuring that the products they list or rent comply with all applicable laws and regulations.

Users shall not impersonate another individual, business, government authority, or organisation, nor shall they create fake identities, provide false verification documents, or intentionally misrepresent product ownership, product condition, pricing, specifications, or availability. Any attempt to deceive other users or Rentnear may result in immediate account suspension, cancellation of ongoing transactions, forfeiture of deposits where applicable, and legal action.

The platform shall not be used to transmit viruses, malware, spyware, ransomware, malicious code, automated bots, scripts, or any software intended to disrupt, damage, overload, reverse engineer, or gain unauthorised access to Rentnear's systems, servers, databases, or other users' accounts. Users shall not attempt to bypass security measures, interfere with platform operations, scrape data, manipulate search rankings, or exploit software vulnerabilities.

Users agree not to use the platform for spam, unsolicited commercial communications, phishing, chain messages, fake reviews, fake enquiries, or any activity intended to manipulate marketplace ratings, search results, or user trust. Any attempt to artificially influence reviews, ratings, bookings, or platform reputation is strictly prohibited.

Users must respect the privacy of others and shall not publish or disclose another person's personal information, including names, addresses, phone numbers, email addresses, government identification details, financial information, or photographs, without obtaining their explicit consent. Rentnear reserves the right to remove any content that violates privacy rights or applicable data protection laws.

Users are solely responsible for all content they upload, including product descriptions, photographs, videos, pricing information, availability, documents, reviews, comments, and communications exchanged through the platform. Rentnear may review, moderate, edit, restrict, or remove any content that violates these Terms of Use or that may negatively impact the integrity, reputation, or safety of the marketplace.

Users shall comply with the provisions of the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, applicable consumer protection laws, intellectual property laws, and all other laws, rules, notifications, and regulations currently in force within India. Any violation of these laws shall be the sole responsibility of the user, and Rentnear shall not be liable for any civil, criminal, or regulatory consequences arising from such violations.

Rentnear reserves the right, at its sole discretion and without prior notice, to suspend, restrict, investigate, or permanently terminate any account found to be violating these Terms of Use or engaging in activities that may compromise the security, integrity, or reputation of the platform or its users.

The Rentnear platform may contain product listings, user-generated content, reviews, ratings, photographs, videos, descriptions, advertisements, educational materials, blogs, external references, and links to third-party websites or services. Such content is provided solely for informational and marketplace purposes.

Rentnear does not own, operate, or control third-party websites or external services linked through the platform and shall not be responsible for the accuracy, availability, legality, security, reliability, or privacy practices of such external websites. Accessing any third-party website is entirely at the user's own risk, and users are encouraged to review the terms and privacy policies of those websites before interacting with them.

Users acknowledge that product descriptions, specifications, images, rental pricing, availability, and other listing information are primarily provided by verified lenders and may occasionally contain errors or inaccuracies. Although Rentnear undertakes reasonable verification measures and quality checks wherever applicable, Rentnear does not guarantee that every listing is complete, accurate, current, or error-free.

By uploading product photographs, descriptions, videos, reviews, comments, feedback, suggestions, or other content to the platform, users grant Rentnear a worldwide, royalty-free, non-exclusive, transferable licence to use, reproduce, publish, display, distribute, translate, modify, and promote such content for operating, improving, marketing, and advertising the platform without requiring additional consent or compensation. Ownership of the original content remains with the user unless otherwise agreed.

Rentnear reserves the right to review, edit, reject, remove, or disable any content that violates these Terms of Use, infringes intellectual property rights, contains misleading information, promotes prohibited products, or may adversely affect other users or the platform.

All logos, trademarks, brand names, service marks, software, designs, graphics, icons, website layouts, illustrations, source code, and other proprietary materials displayed on the Rentnear platform are protected by applicable intellectual property laws and remain the exclusive property of Rentnear or their respective owners. Nothing contained on the platform shall be interpreted as granting any licence or right to use such intellectual property without prior written permission.

Product photographs displayed on Rentnear may include manufacturer images, lender-uploaded images, or platform-generated images for illustrative purposes. Actual products may vary in appearance, condition, included accessories, or packaging depending on the lender's listing and verification status.

Users are responsible for ensuring that the information they upload is accurate, lawful, complete, and does not infringe the rights of any third party. Rentnear reserves the right to suspend listings or accounts that repeatedly publish inaccurate or misleading information.

Users shall not copy, reproduce, scrape, distribute, download, modify, republish, sell, or commercially exploit any content available on the Rentnear platform without obtaining prior written permission from Rentnear or the applicable rights holder.

Users agree not to publish false, defamatory, malicious, or misleading reviews or statements intended to damage the reputation of Rentnear, its users, partners, employees, or affiliated businesses. Genuine reviews based on actual rental experiences are encouraged, provided they remain truthful, respectful, and comply with applicable laws.

Rentnear continually updates and improves the platform and therefore reserves the right to modify, replace, suspend, or remove any content, features, services, or functionality at any time without prior notice.

These content policies are intended to protect the integrity of the Rentnear marketplace while ensuring a transparent, trustworthy, and secure experience for all users.

Rentnear is a technology-enabled rental marketplace that connects verified lenders and renters through a secure platform. While Rentnear facilitates product listings, payments, identity verification, logistics coordination, and customer support, the availability of any product or service is subject to successful verification, operational feasibility, product condition, lender acceptance, and other internal quality and security checks.

Rentnear reserves the right to cancel, reject, suspend, modify, or partially fulfil any booking or rental request at any time before delivery, with or without prior notice, where required for reasons including but not limited to product unavailability, failed verification, suspected fraud, payment issues, safety concerns, inaccurate listings, operational limitations, force majeure events, or violations of these Terms of Use. In such cases, any eligible payment collected from the customer shall be refunded to the original payment method within the applicable banking timelines.

Each booking made on Rentnear shall be treated as an independent transaction. Previous bookings, rental history, customer ratings, or successful order fulfilment do not guarantee approval, acceptance, or availability of future rental requests. Rentnear reserves the right to perform fresh verification and risk assessment for every transaction.

To provide a seamless rental experience, Rentnear may engage verified third-party service providers for services including but not limited to logistics, payment processing, KYC verification, insurance, customer support, technical infrastructure, fraud detection, communication services, and dispute resolution. Users expressly authorize Rentnear to share only the minimum information necessary with such authorised partners solely for the purpose of delivering the requested services. All third-party service providers are contractually required to protect user information in accordance with applicable laws and Rentnear's Privacy Policy.

While Rentnear strives to provide an uninterrupted, secure, and reliable platform, the website and mobile application are provided on an "as available" and "as is" basis. Rentnear does not warrant that the platform will always be uninterrupted, error-free, free from delays, compatible with every device, or completely immune from technical failures, cyber-attacks, viruses, malware, or other harmful components. Users acknowledge that internet connectivity, telecommunications infrastructure, third-party systems, and external factors are beyond Rentnear's reasonable control.

Information displayed on the platform, including product descriptions, specifications, pricing, rental availability, images, ratings, reviews, and estimated earnings, is provided for general informational purposes. Although Rentnear undertakes reasonable verification procedures wherever applicable, it does not guarantee that all information is complete, accurate, current, or free from typographical or technical errors. Users are encouraged to verify product details before confirming any transaction.

Nothing published on the Rentnear platform shall be construed as legal, financial, tax, insurance, investment, or professional advice. Users are solely responsible for conducting their own due diligence before entering into any rental transaction or relying upon any information available on the platform.

Rentnear reserves the right, at its sole discretion and without prior notice, to temporarily suspend, restrict, modify, discontinue, or enhance any part of the platform, its services, features, policies, or access whenever necessary to maintain security, improve service quality, comply with legal obligations, or protect the interests of its users and business operations.

The user agrees to defend, indemnify, and hold harmless Rentnear, its parent company, subsidiaries, affiliates, directors, officers, employees, representatives, contractors, technology partners, logistics partners, payment partners, agents, successors, and assigns from and against any claims, actions, proceedings, losses, liabilities, damages, penalties, fines, costs, expenses, legal fees, or demands arising directly or indirectly from the user's use of the Rentnear platform.

This indemnification includes, but is not limited to, claims arising from the user's breach of these Terms of Use, Privacy Policy, Damage Policy, Shipping Policy, Refund Policy, Intellectual Property Policy, or any other applicable policy published by Rentnear. It also covers claims arising from inaccurate information provided by the user, misuse of rented products, fraudulent activity, intellectual property infringement, unlawful listings, violation of applicable laws, breach of third-party rights, negligence, misconduct, or any action that causes loss or damage to Rentnear or other users of the platform.

The user further agrees to indemnify Rentnear against any damages arising from unauthorised access to their account resulting from their own negligence, misuse of login credentials, failure to secure their devices, or any breach caused by their actions or omissions.

The obligations under this clause shall survive the termination or suspension of the user's account and shall continue to remain enforceable even after the completion or cancellation of any rental transaction.

All intellectual property rights associated with the Rentnear platform, including but not limited to the Rentnear name, logo, trademarks, service marks, trade names, software, website design, user interface, graphics, icons, illustrations, source code, databases, photographs, videos, text, documentation, marketing materials, algorithms, and all related content are owned by or licensed to Rentnear and are protected under applicable copyright, trademark, patent, and intellectual property laws.

Users are granted a limited, non-exclusive, non-transferable, and revocable licence to access and use the platform solely for personal, lawful, and non-commercial purposes in accordance with these Terms of Use. Nothing contained within the platform shall be interpreted as granting any ownership rights or licence over Rentnear's intellectual property except as expressly provided herein.

Users shall not copy, reproduce, modify, translate, reverse engineer, decompile, scrape, distribute, republish, transmit, publicly display, commercially exploit, create derivative works, or otherwise use any part of the Rentnear platform without obtaining prior written permission from Rentnear.

Users shall not register or attempt to register any trademark, trade name, logo, domain name, company name, application name, social media handle, or other intellectual property that is identical or confusingly similar to Rentnear or any of its branding. Any unauthorised use of Rentnear's intellectual property may result in legal action, including claims for damages and injunctive relief.

Where users upload product photographs, descriptions, videos, reviews, or other content, they represent and warrant that they either own such content or possess all necessary licences and permissions to publish it on the Rentnear platform. The user remains responsible for ensuring that such content does not infringe the rights of any third party.

If any copyright owner or authorised representative believes that any content available on the Rentnear platform infringes their intellectual property rights, they may notify Rentnear by submitting a detailed written complaint along with supporting evidence. Upon receipt of a valid complaint, Rentnear may investigate the matter and remove or disable access to the disputed content where appropriate.

Users acknowledge that during the course of using the Rentnear platform they may obtain access to confidential or proprietary information belonging to Rentnear, its business partners, lenders, renters, service providers, or other users. Such confidential information may include business processes, pricing strategies, software architecture, algorithms, security procedures, operational methods, commercial information, customer data, technical documentation, and any other non-public information.

Users agree to maintain the confidentiality of such information and shall not disclose, reproduce, distribute, publish, exploit, or use any confidential information for any purpose other than the legitimate use of the Rentnear platform without obtaining prior written consent from Rentnear.

This obligation shall survive the termination of the user's account or relationship with Rentnear. Any unauthorised disclosure or misuse of confidential information may result in legal proceedings and claims for damages in addition to any other remedies available under applicable law.

To the maximum extent permitted under applicable law, Rentnear, its affiliates, directors, officers, employees, partners, service providers, and licensors shall not be liable for any indirect, incidental, special, punitive, exemplary, or consequential damages, including but not limited to loss of profits, business interruption, loss of goodwill, loss of data, loss of opportunity, or any other commercial or economic loss arising out of or relating to the use of the Rentnear platform or any rental transaction.

Rentnear acts primarily as a marketplace facilitator that connects verified lenders and renters while providing payment processing, verification services, customer support, and logistics coordination. Except where expressly stated, Rentnear does not manufacture, own, or permanently possess the products listed by independent lenders and therefore cannot guarantee uninterrupted availability, suitability, merchantability, or fitness of every product for a particular purpose.

Where permitted by applicable law, Rentnear's total cumulative liability arising out of any claim relating to a particular transaction shall not exceed the total rental amount actually paid by the user to Rentnear for that specific booking, excluding taxes, delivery charges, security deposits, penalties, or third-party service fees.

Nothing contained in these Terms of Use shall limit or exclude liability where such limitation is prohibited under applicable law, including liability arising from fraud, wilful misconduct, or any statutory rights that cannot legally be excluded or restricted.

These Terms of Use, together with the Privacy Policy, Shipping Policy, Damage Policy, Refund Policy, and all other policies published by Rentnear, shall be governed by and interpreted in accordance with the laws of the Republic of India. By accessing or using the Rentnear platform, every user agrees that all rights, obligations, and legal relationships arising from the use of the platform shall be subject exclusively to Indian law.

Rentnear encourages users to resolve disputes amicably by first contacting our Customer Support or Grievance Officer. Both parties agree to make reasonable efforts to resolve any dispute through mutual discussion before initiating formal legal proceedings.

If any dispute, claim, controversy, or disagreement cannot be resolved amicably, it shall be referred to arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996, including any statutory amendments or re-enactments thereof. The arbitration shall be conducted before a sole arbitrator appointed in accordance with the applicable arbitration rules or by Rentnear where permitted by law.

The juridical seat and venue of arbitration shall be Bengaluru, Karnataka, India, unless otherwise agreed by the parties or directed by the arbitrator. The arbitration proceedings shall be conducted in the English language, and the decision or award passed by the arbitrator shall be final and binding upon all parties.

To provide a faster and more efficient dispute resolution process, Rentnear may administer arbitration proceedings through an Online Dispute Resolution (ODR) platform, including but not limited to Presolv360, or any other recognised arbitration institution. Users expressly consent to receive notices, participate in hearings, exchange documents, and complete arbitration proceedings electronically through email, video conferencing, or other approved digital communication channels wherever legally permissible.

If virtual arbitration is not feasible due to legal, technical, or practical reasons, the arbitrator may direct that the proceedings be conducted physically at an appropriate venue in Bengaluru or such other location as may be determined after considering the convenience of all parties.

Subject to the arbitration provisions contained herein, the courts situated in Bengaluru, Karnataka, India, shall have exclusive jurisdiction over all matters arising out of or relating to these Terms of Use, the Rentnear platform, or any services provided by Rentnear.

By creating an account, accessing the Rentnear platform, or using any of its services, the user acknowledges that they have carefully read, understood, and agreed to be legally bound by these Terms of Use and all other policies published by Rentnear. If the user does not agree with any provision contained in these Terms or any associated policy, the user must immediately discontinue using the platform and close their account.

These Terms of Use, together with the Privacy Policy, Shipping Policy, Damage Policy, Refund Policy, Community Guidelines, and all other published policies, constitute the complete agreement between the user and Rentnear regarding the use of the platform and supersede any previous communications or understandings relating to the same subject matter.

Rentnear operates solely as an independent technology platform facilitating rental transactions between verified lenders and renters. Nothing contained in these Terms shall be interpreted as creating any agency, partnership, employment relationship, joint venture, franchise, or fiduciary relationship between Rentnear and any user unless expressly agreed in writing.

Rentnear shall not be liable for any delay, interruption, suspension, or failure in performing its obligations where such delay or failure results from circumstances beyond its reasonable control. Such circumstances include, but are not limited to, natural disasters, floods, earthquakes, pandemics, epidemics, fire, war, terrorism, civil unrest, strikes, labour disputes, government actions, changes in law, internet outages, power failures, cyber-attacks, transportation disruptions, acts of third-party service providers, or any other force majeure event.

If a user violates any provision of these Terms of Use or any applicable policy, Rentnear reserves the right to suspend or terminate the user's account, cancel bookings, withhold payments where legally permissible, remove listings, restrict platform access, initiate legal proceedings, or exercise any other remedy available under applicable law. Failure by Rentnear to exercise any right immediately shall not constitute a waiver of that right.

If any provision of these Terms is held by a court, tribunal, or competent authority to be invalid, illegal, or unenforceable, such provision shall be modified or interpreted to the minimum extent necessary to make it enforceable while preserving its original intent. The remaining provisions shall continue to remain valid, binding, and enforceable.

No waiver of any breach or default under these Terms shall be deemed a waiver of any subsequent breach. Any waiver shall be effective only if made in writing by an authorised representative of Rentnear.

Rentnear reserves the right to amend, revise, modify, or replace these Terms of Use and any related policies at any time in order to comply with changes in law, improve platform operations, enhance user safety, or reflect changes in business practices. Updated Terms shall become effective immediately upon publication on the Rentnear platform unless otherwise stated. Continued use of the platform after such updates constitutes acceptance of the revised Terms.

By creating a Rentnear account or using any of our services, the user expressly consents to receive communications from Rentnear through electronic means, including email, SMS, WhatsApp, mobile notifications, in-app notifications, telephone calls, and other digital communication channels permitted under applicable law.

Such communications may include account verification, booking confirmations, payment receipts, delivery updates, pickup schedules, security alerts, product availability notifications, dispute resolution updates, policy changes, promotional offers (where consent has been provided), customer support responses, and other information necessary for the operation of the Rentnear platform.

Users are responsible for ensuring that the email address, mobile number, and other contact details registered with Rentnear remain accurate, current, and accessible. Rentnear shall not be responsible for any delay, failure, or inability to deliver communications arising from incorrect, outdated, or inaccessible contact information provided by the user.

Any legal notice, complaint, request, or formal communication intended for Rentnear shall be sent to the official contact details published on the Rentnear website or to the designated legal or grievance email address notified by Rentnear from time to time. Likewise, all notices intended for the user shall be deemed validly delivered when sent to the email address, mobile number, or postal address registered in the user's Rentnear account.

Electronic records, emails, system logs, OTP verifications, digital acknowledgements, electronic signatures, and communication records maintained by Rentnear shall constitute valid evidence of communication and may be relied upon in any legal or dispute resolution proceedings to the extent permitted by applicable law.

Rentnear reserves the right to update, amend, or modify these Terms of Use and all related policies at any time without prior individual notice. The latest version shall always be available on the Rentnear website and mobile application. Users are encouraged to review these Terms periodically, and continued use of the platform after any update shall constitute acceptance of the revised Terms and Conditions.
