Damage Policy

What counts as damage, and how it's handled

1. GENERAL POLICY

Every product rented through Rentnear is carefully documented before dispatch and inspected again after it is returned to the lender or Rentnear's verification centre. If any damage, missing accessory, loss of functionality, or missing component is identified during the return inspection, Rentnear will notify the renter and, where applicable, the lender with supporting photographs, videos, inspection reports, or other relevant evidence.

The renter accepts full responsibility for maintaining the rented product in the same condition in which it was received, excluding reasonable wear and tear arising from normal intended use. Any damage, loss, theft, misuse, negligence, unauthorised modification, or disappearance of the rented product during the rental period shall remain the responsibility of the renter until the product has been successfully returned and accepted by Rentnear or the lender.

Rentnear reserves the right to assess the extent of damage, determine repair or replacement costs, and recover the applicable charges from the renter in accordance with this policy.

2. WHAT IS CONSIDERED DAMAGE?

Damage includes any permanent physical, cosmetic, mechanical, or electronic deterioration that reduces the value, appearance, functionality, safety, or performance of the rented product beyond normal usage.

Examples of damage include, but are not limited to:

  • Broken screens or displays
  • Cracked lenses or camera sensors
  • Bent frames or damaged body panels
  • Water or liquid damage
  • Electrical or electronic failure caused by misuse
  • Missing accessories supplied with the product
  • Scratches, dents, or cracks beyond normal wear
  • Broken buttons, ports, switches, or connectors
  • Software damage caused by unauthorised modification
  • Damage caused by improper storage or transportation

Normal wear and tear resulting from careful and intended use---such as minor surface marks or light cosmetic ageing---will generally not be treated as damage.

Rentnear's inspection team shall make the final determination regarding whether the product condition constitutes normal wear or chargeable damage.

3. MISSING PRODUCT OR ACCESSORY POLICY

Secure Packaging Requirement

Products returned through Rentnear must be packed securely using the approved packaging materials provided or recommended by Rentnear. Where security seals, locks, tamper-evident bags, or protective cases are provided, users must ensure they are properly secured before handing the package to the delivery partner.

If the product or any included accessories become lost or damaged because the package was not securely packed or sealed, the renter may be held financially responsible.

Return of Missing Items

If any accessory or product component is unintentionally omitted during the return process, the renter must immediately notify Rentnear Customer Support.

Rentnear may arrange an additional pickup for the missing item, subject to operational availability. Any additional logistics charges incurred for such collection may be charged to the renter.

Rental charges may continue until all rented products and accessories have been successfully returned.

Lost Products

If the renter permanently loses the rented product or any included accessories, the renter must notify Rentnear immediately.

Rentnear will provide a payment link or invoice for the applicable replacement cost, and payment must be completed within 24 hours of receiving the invoice unless otherwise agreed in writing.

Failure to make payment within the specified time may result in suspension of the user's account, recovery proceedings, legal action, and reporting to appropriate authorities where applicable.

4. DAMAGE CHARGES & PROTECTION

If any rented product is returned with damage or missing components, Rentnear will conduct a detailed inspection and notify the renter of the findings before initiating recovery of repair or replacement costs.

Rentnear Protection Plan (Optional)

Where available, renters may choose to purchase the Rentnear Protection Plan during checkout.

The Rentnear Protection Plan provides protection against eligible accidental damage, subject to its specific Terms and Conditions.

Coverage may include:

  • Accidental physical damage
  • Minor accidental breakage
  • Eligible repair costs

Coverage limits, exclusions, deductibles, and claim procedures shall be governed by the applicable Rentnear Protection Plan purchased during booking.

The Protection Plan Does NOT Cover

The Rentnear Protection Plan does not cover:

  • Intentional or malicious damage
  • Improper handling or negligent use
  • Theft
  • Burglary
  • Robbery
  • Lost or misplaced products
  • Damage caused by unauthorised repairs or modifications
  • Damage caused by illegal use
  • Damage resulting from misuse contrary to manufacturer instructions

Repairable Damage

Where the product can reasonably be repaired:

  • The renter shall pay the actual repair cost, together with any applicable inspection, logistics, or service charges not covered under the Protection Plan.

Irreparable Damage

Where the product cannot reasonably be repaired or restored:

  • The renter shall be responsible for paying the **current market replacement value** of the product or the replacement amount determined by Rentnear based on fair market valuation.

Loss or Theft

Theft, robbery, burglary, disappearance, or complete loss of rented products are not covered under the standard Rentnear Protection Plan unless expressly stated otherwise.

Where a product is lost or stolen during the rental period, the renter shall be responsible for paying the applicable replacement value determined by Rentnear.

For complete transparency, Rentnear will provide a detailed invoice showing the calculation of all applicable charges.

5. DISPUTE & INSPECTION PROCESS

If a renter disputes a damage assessment, they may raise a dispute with Rentnear Customer Support within 48 hours of receiving the inspection report.

Rentnear may review:

  • Product photographs
  • Pre-rental inspection reports
  • Return inspection reports
  • Delivery documentation
  • Packaging records
  • Video recordings (where available)
  • Statements from the lender and logistics partner

After completing its investigation, Rentnear shall communicate its final decision. This decision shall be binding unless otherwise required by applicable law or dispute resolution proceedings.

6. NON-COMPLIANCE

Failure to comply with this Damage Policy or refusal to pay verified repair or replacement charges may result in one or more of the following actions:

  • Temporary or permanent suspension of the Rentnear account.
  • Cancellation of current or future bookings.
  • Adjustment or forfeiture of the security deposit, where applicable.
  • Recovery of outstanding amounts through legal or collection proceedings.
  • Reporting fraudulent activity to the appropriate law enforcement or regulatory authorities.
  • Restriction from using any Rentnear services in the future.

Rentnear reserves the right to pursue all remedies available under applicable laws of India to recover any losses arising from damage, misuse, theft, or non-compliance with this Damage Policy.
